Actually, It Ain’t Over…
I received a notice in the mail today from Lawyer, Lawyer, and Lawyer….The Colwood Partnership is appealing the Council decision to the Land Use Board of Appeal.

As unsatisfying as it may sound, the answer is wait and see.
To prevail at LUBA, the Colwood Partnership must prove that the decision made by the City was legally insufficient given the evidence in the official record (public testimony, staff analysis, information already presented by Colwood’s representatives, etc.)
No new evidence can be presented and the burden of proof is squarely on the Colwood Partnership. The Portland City Attorney’s office will be defending the City’s decision in this matter.
The LUBA hearing will likely occur in January or February, we will post any and all new information here.
